1. Acceptance of Terms
By accessing or using BLuxA Transportation's Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and BLuxA Transportation.
You must be at least 18 years old to use our Services. If you are using our Services on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.
2. Service Description
BLuxA Transportation provides premium luxury transportation services, including but not limited to:
- Airport transfers and ground transportation
- Corporate travel and executive transportation
- Special events and wedding transportation
- City tours and sightseeing
- Hourly charter services
- Long-distance and intercity transportation
Our Services are available in New York City, New York, United States, and the Dominican Republic. We operate a fleet of luxury vehicles including executive sedans, luxury SUVs, sprinter vans, and stretch limousines, all driven by professional, licensed chauffeurs.
We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time, with or without notice, at our sole discretion.
3. Bookings and Reservations
3.1 Booking Process
All bookings must be made through our official website, mobile application, or authorized booking channels. When you make a booking, you agree to provide accurate, current, and complete information about yourself and all passengers.
3.2 Booking Confirmation
Your booking is not confirmed until you receive a confirmation email or SMS with a booking code. We reserve the right to refuse or cancel any booking at our discretion, including but not limited to situations where:
- The requested service is unavailable
- You provide false or misleading information
- You fail to comply with these Terms
- There are safety concerns
3.3 Pricing
All prices are quoted in U.S. Dollars (USD) unless otherwise stated. Prices are subject to change without notice. Final pricing may vary based on actual route, distance, duration, traffic conditions, and additional services requested. You will receive the final price before confirming your booking.
3.4 Modifications
You may request modifications to your booking by contacting us at least 24 hours before your scheduled pickup time. We will accommodate modifications subject to availability and may charge additional fees for significant changes.
4. Cancellations and Refunds
4.1 Cancellation Policy
You may cancel your booking at any time. Cancellation fees apply as follows:
- More than 48 hours before pickup: Full refund, minus a 5% processing fee
- 24-48 hours before pickup: 50% refund
- Less than 24 hours before pickup: No refund
- No-show: No refund
4.2 Refund Processing
Refunds, when applicable, will be processed to the original payment method within 5-10 business days. Refunds may take longer depending on your financial institution.
4.3 Our Cancellation Rights
We reserve the right to cancel your booking due to:
- Unforeseen circumstances or force majeure events
- Safety concerns
- Non-payment or payment issues
- Violation of these Terms
In such cases, we will provide a full refund or offer an alternative booking at no additional cost.
5. Payment Terms
5.1 Payment Methods
We accept major credit cards, debit cards, and corporate accounts. Payment is required at the time of booking or as otherwise agreed in writing for corporate accounts.
5.2 Payment Processing
All payments are processed securely through our payment processors. By providing payment information, you represent and warrant that you have the legal right to use the payment method.
5.3 Additional Charges
Additional charges may apply for:
- Waiting time beyond the included grace period (typically 15 minutes)
- Tolls, parking fees, and airport fees
- Extra stops or route deviations
- Extended service time beyond the booked duration
- Damages to vehicles or cleaning fees
5.4 Taxes and Fees
All applicable taxes, fees, and surcharges will be included in your final price. You are responsible for any additional fees imposed by airports, venues, or other third parties.
6. User Responsibilities
You agree to:
- Provide accurate and complete booking information
- Be present at the pickup location at the scheduled time
- Treat our vehicles and drivers with respect
- Comply with all applicable laws and regulations
- Not engage in any illegal activities in our vehicles
- Not smoke, consume alcohol (if prohibited), or use illegal substances in our vehicles
- Not damage or deface our vehicles
- Be responsible for the conduct of all passengers in your party
- Pay for any damages caused by you or your passengers
You are responsible for ensuring that all passengers comply with these Terms. Violation of these responsibilities may result in immediate termination of service without refund.
7. Limitation of Liability
7.1 General Limitation
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUXA TRANSPORTATION, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OUR SERVICES.
7.2 Maximum Liability
Our total liability to you for all claims arising from or related to the Services shall not exceed the amount you paid for the specific service giving rise to the claim.
7.3 Third-Party Services
We are not responsible for delays, cancellations, or other issues caused by third parties, including but not limited to traffic conditions, weather, accidents, road closures, or actions by government authorities.
7.4 Personal Property
We are not responsible for any loss, theft, or damage to personal property left in our vehicles. You are responsible for securing your belongings.
8. Intellectual Property
All content on our website and in our Services, including but not limited to text, graphics, logos, images, software, and trademarks, is the property of BLuxA Transportation or its licensors and is protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any content from our Services without our prior written consent.
9. Termination
We may terminate or suspend your access to our Services immediately, without prior notice, for any reason, including if you breach these Terms or engage in fraudulent, illegal, or harmful activities.
Upon termination, your right to use the Services will cease immediately. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to liability limitations, dispute resolution, and governing law provisions.
10. Dispute Resolution
10.1 Informal Resolution
Before initiating any formal dispute resolution process, you agree to contact us first to attempt to resolve the dispute informally. Please contact us at legal@bluxatransportation.com with details of your dispute.
10.2 Binding Arbitration
If informal resolution is unsuccessful, any dispute arising out of or relating to these Terms or our Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA), rather than in court. The arbitration shall take place in New York, New York.
10.3 Class Action Waiver
You agree that any disputes must be brought in your individual capacity and not as a plaintiff or class member in any purported class action or representative proceeding.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. For services provided in the Dominican Republic, Dominican Republic law may also apply.
Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in New York County, New York, and you consent to the personal jurisdiction of such courts.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our Services after such modifications constitutes your acceptance of the updated Terms.
If you do not agree to the modified Terms, you must stop using our Services and may cancel any pending bookings in accordance with our cancellation policy.
